Who is responsible for data collection on this website?

Analysis tools and third-party tools

When visiting our website, your surfing behavior may be statistically analyzed. This is done primarily with cookies and with so-called analysis programs. The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration.

Personal data (hereinafter referred to as “data”) is processed by us only as necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there.

Pursuant to Art. 4 No. 1. of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to only as “GDPR”), “processing” means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, arrangement, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

With the following privacy policy, we inform you in particular about the nature, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide either alone or jointly with others on the purposes and means of processing. In addition, we inform you below about the third-party components used by us for optimization purposes as well as to increase the quality of use, insofar as third parties process data through this, again under their own responsibility.

B. Rights of users and data subjects

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 DSGVO).

If data processing is carried out on the basis of Art. 6(1)(e) or (f) DSGVO, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims (objection under Article 21(1) DSGVO).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling, insofar as it is related to such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection pursuant to Article 21 (2) DSGVO).

Right of complaint to the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged violation. The right of appeal is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done insofar as it is technically feasible.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of data processing and, if necessary, a right to correction, blocking or deletion of this data. Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. To do this, you can contact us at any time at the address given in the imprint. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data has happened / is happening unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of erasure.
  • If you have lodged an objection pursuant to Art. 21 (1) DSGVO, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

C. Information on data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose of the storage no longer applies, the deletion of the data does not conflict with any statutory retention obligations and no other information is provided below on individual processing procedures.

Server data

For technical reasons, in particular to ensure a secure and stable Internet presence, data is transmitted to us by your Internet browser. These so-called server log files are used to collect, among other things, the type and version of your Internet browser, the operating system, the website from which you accessed our website (referrer URL), the website(s) of our website that you visit, the date and time of the respective access as well as the IP address of the Internet connection from which the use of our website takes place.

The data collected in this way is stored temporarily, but not together with other data about you. This storage takes place on the legal basis of Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in the improvement, stability, functionality and security of our website. The data is deleted again after seven days at the latest, unless further storage is required for evidence purposes. Otherwise, the data is exempt from deletion in whole or in part until final clarification of an incident.

Cookies
a) Session cookies/Session cookies

We use so-called cookies with our Internet presence. Cookies are small text files or other storage technologies that are placed and stored on your terminal device by the Internet browser you use. Through these cookies, certain information from you, such as your browser or location data or your IP address, is processed to an individual extent. This processing makes our website more user-friendly, effective and secure. We create cookies to determine the language you have set, to store your login status and anonymized data about your use of our website. The use of cookies is justified by our legitimate interest in improving the functionality of our website. The legal basis is then Art. 6 para. 1 lit. f) DSGVO. When you close your internet browser, these session cookies are deleted.

B) Removal option

You can prevent or restrict the installation of cookies by setting your internet browser. Likewise, you can delete already stored cookies at any time. However, the steps and measures required for this depend on your specific Internet browser used. If you have any questions, please use the help function or documentation of your Internet browser or contact its manufacturer or support. In the case of so-called Flash cookies, however, processing cannot be prevented via the browser settings. Instead, you must change the settings of your Flash player. The steps and measures required for this also depend on the specific Flash player you use. However, if you prevent or restrict the installation of cookies, this may mean that not all functions of our website can be fully used.

Registration function

If you create a user account with us via our website, we will collect and store the data you entered during registration (e.g. your name and e-mail address) so that you can log in with your user account in the future. At the same time, we will then store the IP address and the date of your registration along with the time. This data will not be passed on to third parties. During the further registration process, your consent to this processing will be obtained and reference will be made to this data protection declaration. Insofar as you consent to this processing, Art. 6 para. 1 lit. a) DSGVO is the legal basis for the processing. In accordance with Art. 7 (3) DSGVO, you can revoke the consent given to us for the opening and maintenance of the user account at any time with effect for the future. For this purpose, you only need to inform us of your revocation.

The data collected in this respect will be deleted as soon as processing is no longer necessary. In doing so, we must observe statutory retention periods.

Contact requests / contact option

If you contact us via contact form or e-mail, the data you provide will be used to process your request. The provision of the data is necessary for processing and answering your request – without their provision, we can not answer your request or at best limited. The legal basis for this processing is Art. 6 para. 1 lit. b) DSGVO. Your data will be deleted if your inquiry has been answered conclusively and the deletion does not conflict with any statutory retention obligations, such as in the case of any subsequent contract processing.

User contributions, comments and ratings

We offer you the opportunity to publish comments and tags on our website, hereinafter referred to as “contributions”. If you make use of this offer, we process and publish your contribution, date and time of submission as well as the pseudonym used by you, if applicable. The legal basis for this is Art. 6 para. 1 lit. a) DSGVO. In accordance with Art. 7 (3) DSGVO, you can revoke your consent at any time with effect for the future. For this purpose, you only need to inform us of your revocation.

In addition, we also process your IP and e-mail address. The IP address is processed because we have a legitimate interest in initiating or supporting further steps if your contribution infringes the rights of third parties and/or it is otherwise illegal. The legal basis in this case is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in the legal defense that may be necessary.

D. Integration of services of external providers

To improve the functionality of our website and an optimized user experience, we use the following services from external providers:

OpenstreetMaps

In our website we use OpenStreetMap to display some features of the database. Specifically, map sections provided by OpenStreetMap display locations that are related to the respective search queries or objects. The maps provided are based on the Open Data Commons Open Database License (ODbL) by the OpenStreetMap Foundation (OSMF). User data is used by OpenStreetMap solely for the purpose of displaying the map functions and for caching the selected settings. This data may include, in particular, IP addresses and location data of the users, which, however, are not collected without their consent (usually executed within the settings of their mobile devices).

Google reCAPTCHA

We use Google reCAPTCHA on our website to check and prevent interactions on our website by automated access, e.g. by so-called bots. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as “Google”. Through certification under the EU-US Privacy Shield („EU-US Privacy Shield“), Google guarantees that the data protection requirements of the EU are also complied with when processing data in the USA. Through this service, Google can determine from which website a request is sent as well as from which IP address you use the so-called reCAPTCHA input box. In addition to your IP address, other information may be collected by Google that is necessary for the offer and guarantee of this service. The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in the security of our website and in the defense against unwanted, automated access in the form of spam or similar.

Matomo (formerly: PIWIK)

We use Matomo (formerly: “PIWIK”) on our website. This is an open source software that allows us to analyze the use of our website. Your IP address, the website(s) you visit on our website, the website from which you linked to our website (referrer URL), the time you spend on our website and the frequency with which you visit one of our websites are processed. To collect this data, Matomo stores a cookie on your terminal device via your Internet browser. This cookie is valid for one week. The legal basis is Art. 6 para. 1 lit. f) DSGVO. Our legitimate interest lies in the analysis and optimization of our website.

However, we use Matomo with the anonymization function “Automatically Anonymize Visitor IPs”. This anonymization function shortens your IP address by two bytes, so that it is impossible to assign it to you or to the Internet connection you are using. If you do not agree to this processing, you have the option of preventing the storage of the cookie by means of a setting in your Internet browser. You can find more information on this above under “Cookies”.

In addition, you have the option of ending the analysis of your usage behavior by way of the so-called opt-out.

By confirming the link, a cookie is stored on your end device via your Internet browser, which prevents further analysis. Please note, however, that you will have to click the above link again if you delete the cookies stored on your terminal device.
